Mortgage loan renegotiation rules are already in effect

What are the criteria?

With regard to the renegotiation of contracts, it is considered that there is a “significant worsening” of the effort rate when it reaches 36% following a 5 percentage point increase against the effort rate in the same period (for contracts concluded in the last 12 months, against the date of its conclusion) or as a result of a equal or greater increase in the reference index of the contract in question against the value considered for the purposes of projecting the impact of the future increase in that index. It is also considered a “significant aggravation” of the effort rate in cases where the rate was already above 36% in the same period and there has been an aggravation by one of the two ways explained above. Finally, it is considered that there is a “significant effort rate” when the customer effort rate is greater than 50%.

Which contracts are covered by the new measures?

The new rules regarding the renegotiation of credits only apply to home loan agreements with a variable rate, with an outstanding capital of less than 300 thousand euros, and which are intended for the purchase or construction of own and permanent housing.
